As of 8/18/98 I have not yet found a census record for this family in 1870. Census records exist for 1850, 1860, and 1880. In 1850 he is in Cherokee Co., Alabama, in 1860 he is in DeKalb Co., Alabama. In the 1860 census, Charles children were: William, Hiram, John, and James. His wife's name appears to be Jemima or Jenina. Now in the 1880 census, the family was found in Wise Co., Texas. Hiram, John, and James were in the census, along with Jane, and three additional children of Margaret, Malinda and Lemuel. According to her death certificate, Malinda's place of birth is given as Miller Co., Missouri. Therefore, from 1860 to 1880 Charles moved from Alabama to Missouri, and died somewhere in Missouri. It could be assumed that since he was in his forties by the time the war started that he probably did not serve. It may also be assumed that he may have moved his family to Missour during the war since Margaret was born in Alabama in 1861, but no other children were born till 1866. According to the 1880 census, Jane was 44, placing her year of birth as 1836. In the Lemuel Kennedy family bible, her year of birth is given as 1833, which coincides with the year of birth for Charles wife in the 1850 and 1860 census. Also, the place of birth for Charles wife is Tennessee, and Jane's place of birth is also Tennessee.

Males: William is the 40 to 50 year old, and Charles is the 10 to 15; Barnabas is the 5 to 10 year old.
Females: Mary Miller Arthur is the 20 to 30 year old, while an unknown daughter is in the 5 to 10 group and Elizabeth is in the under 5 group.From the Kennedy family bible, notes that Malinda's father died the next year after her birth. The bible notes her birth year as 1862, however, her death certificate and the 1880 census both give her birth year as 1866. Malinda had a younger brother, Lemuel Arthur, born in 1867, according to the 1880 census for Wise Co., Texas, and the 1920 census for Jefferson Co., Oklahoma. However, in the 1900 census for Indian Territory and the 1910 census for Oklahoma, his year of birth is given as 1872, therefore, Charles date of death would more than likely fall between 1868 and 1873, depending upon the year of birth for Lemuel Arthur. This assumes that the family bible is correct in stating he died soon after Malinda's birth. Unfortunately, very little is known about Charles or his wife Jane, so verification will be diffcult at best, if not impossible. It is possible that he died sometime before Lemuel Arthur's birth, since

Apparently the family moved to Missouri sometime between 1861 and 1866. Her daughter, Margaret E. was born in Alabama in about 1861, and her other daughter, Malinda Allie, was born in Miller Co., Missouri in 1866. Her youngest, Lemual H. was also born in Missouri in 1867. The family then left Missouri sometime between 1872 and 1874, passing through Arkansas, remaining in the state till 1876. By early 1876, the family had made its way to Texas and had settled in Wise County. Then in early 1882 the family moved once more into Indian Territory. We find them scattered throughout the territory, particularly in the southern half.

However, the birth year may be incorrect, according to the Kennedy Family bible, it is 1833 and she was born in Tennessee. Both the 1850 and 1860 census' indicate her birth year to be 1833 also, and in Tennessee. The 1880 Wise Co., Texas census indicates her birth year to be 1836, and still Tennessee. So, if this is James' mother, then we must assume that the year of birth is in error as well as James'. Imagine, a woman not giving her correct year of birth.According to the Lemuel P. Kennedy family bible, her year of death is 1895. However, the entries appear to be made all at one time, and thus it would seem that they were made sometime later than her actual death. Jemima's name is J. A. Arthur, in the bible.

He is no where to be found in the 1920 Oklahoma Census. His brother, Lemuel Arthur has moved to Jefferson Co., Oklahoma and after having lived with him since before 1900, he is no longer with him. One can only think that he may have passed away.

30. Barnabas Arthur
Beginning with Barnabas and Margaret, they and their descendants spell their name ArthEr.
Barnabas served two tours in the Civil War, 1st enlistment began on 29 March 1861 for 12 months. He was assigned to Capt. Clares' Co., Alabama Volunteers, also known as "The Cherokee Greys". This unit was "mustered in" to the Confederate Army and was designated Co. C, 7th Alabama Infantry Regiment. The regiment's one year enlistment expired shortly before the Battle of Shiloh. Barnabas returned home in the early spring of 1862 and layed in a crop. After harvest, Barnabas prepared to re-enlist. William, the eldest son of Barnabas and Margaret begged his parents for permission to join the army with his Father. On November 15, 1862 they both enlisted at Cherokee City, Alabama as privates in Co. C, 2nd Battalion, 7th Alabama Calvary Regiment, later known as the 9th Alabama Calvary Regiment, commanded by Lt. Col. James Malone and was part of the Whartons Brigade, Wheeler's Corps, Braggs Army of Tennessee. After wintering in Nashville, the Union Army under General Rosecrans began a southern march in the Spring of 1863 and was opposed by General Bragg's Army of Tennessee. Several skirmishes took place between Nashville and Tullahoma, Tennessee. The most significant and costly took place near Shelbyville, when the Union Army under heavy fire and extreme caualties made a successful of Duck Creek, a large tributary of the Tennessee River. During the three day battle, Barnabas was killed on the 27th of June, 1863. After the battle was over, William returned to the battle field, found his Father, fashioned a coffin from pilings of fence destroyed during the battle, wrapped his Fathers body in his Army blanket and buried him beside the river. William remained with the regiment until the war was over. Barnabas' body was lter disinterred and reburied in the National Cemetery at Shelbyville.
After her husband, Barnabas, was killed in the Civil War, Margaret took her family and moved to Texas.
