There are three agencies in the US government responsible for regulating biotechnology. They are: the United States Department of Agriculture (USDA), the Environment Protection Agency (EPA), and the Food and Drug Administration (FDA).

The following are regulations that are currently in place.
- Passed on May 29, 1992
- Ensures that new products are safe
- Does not establish special labeling requirements for bio-engineered foods
- Does establish labeling requirements if:
- bio-engineered food is significantly different from its traditional counterpart so that the old name no longer accurately describes the new product
- an issue exists for the food regarding how the food is used or consequences of its use
- bio-engineered food has a significantly different nutritional property
- there is a presence of an allergen that the consumer would not expect to be in the food

- Passed on April 28, 1993
- Tried to answer questions raised by 57 FR 22984
- FDA reaffirmed its stance on not requiring special labeling of all genetically modified food
- Also recognized that consumers may not recognize "GM" or "GMO" on label, therefore if a label is required by 57FR 22984, it must be written out "genetically modified" or "genetically engineered"
- Passed on December 21, 2000
- Requires that "all but the smallest organic operations" be certified by a USDA accredited agent
- If a food is labeled as "organic" it cannot have been produced using biotechnology methods
